The Terms and Conditions of Use for DNA Art US LLC and the use of the website (“Site”) http://www.dna-art-us.com.  Any person visiting the Site is referred to as a user (“User”). Users who decide to purchase Goods and Services become a customer (“Customer”).  It is the responsibility of the User prior to using this Site, to carefully read the terms and conditions.


By using the Site, you agree to the Terms and Conditions of Use as stated, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing the Site. The copyright in all materials on the Site, trademarks (whether registered or not), names, logos and the like, are the property of their respective owners. Nothing contained on this Site should be construed as granting any license or right to use or reproduce, in whole or in part, any content without the prior written permission of the Site owner.

The Terms and Conditions of Use are subject to revision without notice. Any such revisions will be binding and effective immediately upon posting of the revised Terms and Conditions of Use on the Site. Your continued use of the Site constitutes agreement to any revision of Terms and Conditions of Use.  Therefore, we advise you to check the conditions for changes periodically.

User License

Users of the Site may browse the publicly accessible part of the Site only.  Users may not access or attempt to access areas of the Site not available to the public. Users may choose to purchase Goods and Services via the Site.

We recommend viewing the Site on correctly functioning and color calibrated monitors to see the accurate colors of the artworks and artwork representations. Uncalibrated and older monitors may display colors that vary significantly.

The Services are not intended for business or commercial purposes and may not be copied or sold.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by us at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

This Agreement shall be governed in all respects by the laws of the United States of America and by the laws of the State of North Carolina. Each of the parties irrevocably consents to the exclusive personal jurisdiction of the federal and state courts located in North Carolina, as applicable, for any matter arising out of, or relating to, this Agreement, except that in actions seeking to enforce any order or any judgment of such federal or state courts located in North Carolina, such personal jurisdiction shall be nonexclusive.


The materials on the Site are provided “as is”. We makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, while we take all reasonable care to ensure that the information contained on the Site is accurate and up to date, we do not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on the Site, or otherwise relating to such materials or on any sites linked to the Site.

We do not employ medical experts and is not a medical organization. Our employees and partners do not give medical advice nor offer diagnoses. The DNA material is exclusively extracted from cells obtained from the cheek membrane for the purpose of producing art.

We cannot guarantee that the Site will function uninterrupted or error free at all times without limitations or interruptions, partly due to necessary maintenance and the dependence of the Site on the internet and associated technologies. We will strive to remedy interruptions and limitations as speedily as possible, and to limit, as much as is reasonably possible, any nuisance the User or Customer might experience as a result of it.

While reasonable precautions are taken, no warranty is given that defects will be corrected or that the Site or the server that makes it available are free of viruses or anything else which may be harmful or destructive.

The Site is updated and improved on an ongoing basis. We reserve the right to change or remove, temporarily or permanently, the Site or any part of it without notice and you confirm that we shall not be liable to you for any such change or removal; and changes to these Terms and Conditions of Use may be made at any time and your use of the Site, or the purchase of Goods and Services, are subject to any such changes. You agree to check to see if any changes have been made to the Terms and Conditions of Use each time you visit the Site or purchase Goods and Services from it.

Limitation Of Liability

Users and Customers agree that our entire liability, and your exclusive remedy, with respect to any Goods and Services provided under the Terms and Conditions of Use and any breach of the Terms and Conditions of Use is solely limited to the amount you paid for such Goods and Services. We shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use any of its services or for the cost of procurement of substitute services.

Purchasing Goods And Services

Users of the Site who order products become Customers, and enter into an agreement with us requesting the manufacture of artwork in the style, color palette, size and material selected. Our aim is to provide you with high quality art made from the DNA sample(s) you provide.

Our customer service is second to none and we strive to make sure that you are satisfied with your unique DNA artworks. We also know that communication is important and we provide updates throughout the laboratory, design, printing and delivery processes.

Security is important to everyone and information you provide is kept secure. We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of personal information, username, password, transaction information and data stored on our Site when you place an order.

Sensitive and private data exchange between the Site and its Users happens over Secure Socket Layer (SSL) secured communication channel and is encrypted and protected with digital signatures. Payment information, including credit card information is also transmitted via Secure Socket Layer (SSL) technology and encrypted into our payment gateway provider’s database.  This data is kept securely and confidentially with access available to only those with the correct authority.  Following the completion of your transaction your private information is not stored on our servers.

Order requests that differ from the standard range of Goods and Services offered are custom orders.  We are keen to work with Customers who want something that differs from the standard range and we will work closely with you to define, produce and deliver what you are looking for.

While most orders are satisfied within the usual eight weeks, from the date the DNA sample is received from the Customer, there can be times when that time scale is delayed by forces beyond our control.  In such an event we are not liable to pay any compensation for any delays.  To avoid this kind of situation it is recommended that you place your order well in advance of the date the want to receive the products.

By placing an order with us, the Customer declares that his/her DNA material is given up voluntarily. This will only be used to create a unique piece of art. The DNA sample will be destroyed in the laboratory after the process has finished.

The patterns shown on the artworks and artwork representations are indicative and, due to the uniqueness of the individual DNA and the process of realizing the artwork, the pattern will vary.

Any changes or additions requested by the Customer may be subject to additional charges.  Any changes or additions due to errors on our part are not chargeable.

Promotional offers including any items provided free of charge are only available to Customers purchasing artwork under the terms of the offer and in the event of order cancellation the promotional offers including any items provided free of charge are relinquished and no longer applicable.

Placing an order via the Site, or any other means, constitutes a contract and you are assumed to have read and understood these Terms and Conditions of Use. All orders placed via the Site are deemed to be an offer by you to purchase the Goods and Services that we supply subject to acceptance of the order by us. We reserve the right to choose not to accept any order for any reason which may or may not be disclosed.  In the event that an order is refused any monies paid will be refunded with 28 days.

Payment Terms

Payment is due, in full, at the time an order is placed. Payments made at the time an order is placed are dealt with seamlessly by our third party vendor, PayPal, and they accept payment from PayPal accounts and by credit card.

In any event, payment needs to be made, in full, and approved or cleared prior to the delivery of the artwork(s).  If full payment is not received we will contact the Customer and/or the appropriate party to work with them to resolve the issue.

Estimates And Quotations

Estimates and quotations are valid for a period of four weeks.  After that time it may be necessary to review and change any part of the estimate or quotation.


We reserve the right to amend the products and services offered from time to time.

Special offers may be made and may be withdrawn or amended from time to time.

We are not responsible for the content of other websites that link to the Site, nor are we responsible for the content of any website to which links are provided from the Site. Links to other websites are provided purely for your convenience and do not imply that we approve of those websites.

Acceptance Of The Terms And Conditions
